Terms of Service — Exolus Node

Please read these Terms of Service ("Terms") carefully before using the Exolus Node software and website operated by Limitless AI, Inc. (formerly Exolus Node AI, Inc.), a Delaware C-Corporation ("Company", "we", "us", or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. The Services

Exolus Node provides screen recording, video editing, and content sharing software available as a desktop application (Windows, macOS, Linux) and as a web application ("Services"). Features vary by subscription plan. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

2. Accounts

→ You must be at least 16 years old to create an account.
→ You are responsible for maintaining the security of your account credentials.
→ You must provide accurate and complete registration information.
→ You are responsible for all activity that occurs under your account.
→ You must notify us immediately at team@exolus-node.pro if you suspect unauthorized access to your account.

3. Subscriptions and Payments

3.1 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All prices are in USD and exclusive of applicable taxes. We use Stripe to process payments. By subscribing, you authorize us to charge your payment method on a recurring basis.

3.2 Free Trial

New users may access a 14-day free trial of the Pro plan. No credit card is required during the trial. At the end of the trial, you will be asked to select a paid plan to continue using premium features.

3.3 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide partial refunds for unused periods.

3.4 Refunds

If you are not satisfied with Exolus Node, you may request a full refund within 30 days of your initial purchase. Refund requests after 30 days are evaluated on a case-by-case basis. To request a refund, contact team@exolus-node.pro.

3.5 Price changes

We may change subscription prices with at least 30 days' advance notice. Price changes will take effect on your next billing cycle after the notice period.

4. Acceptable Use

You agree not to use the Services to:

✕ Record individuals without their knowledge or consent where required by law
✕ Create, share, or distribute illegal, harassing, defamatory, or harmful content
✕ Infringe upon the intellectual property rights of any third party
✕ Attempt to reverse-engineer, decompile, or disassemble the software
✕ Use automated scripts, bots, or scrapers on our website or API without authorization
✕ Resell or sublicense access to the Services without written permission
✕ Interfere with the security or integrity of our servers or networks

Violation of these terms may result in immediate suspension or termination of your account without refund.

5. Your Content

You retain full ownership of all recordings and content you create using Exolus Node ("Your Content"). By storing content on our cloud, you grant us a limited, non-exclusive license to host and deliver Your Content solely for the purpose of providing the Services to you. We do not claim ownership of Your Content and will never use it for training AI models or any other commercial purpose.

6. Intellectual Property

The Exolus Node software, website, logo, design, and all related intellectual property are owned by Limitless AI, Inc. and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our prior written consent. We grant you a limited, non-exclusive, non-transferable license to use the software in accordance with these Terms.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIMITLESS AI, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Termination

We may terminate or suspend your account at any time for violation of these Terms, with or without prior notice. Upon termination, your right to use the Services ceases immediately. You may delete your account at any time from your account settings. Sections 5, 6, 7, 8, and 10 survive termination.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Denver, Colorado.

11. Changes to Terms

We may revise these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice on our website at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
